# Corrective Action

> The action an economic operator must take to bring a non-compliant product into conformity, or otherwise to remove the non-compliance, when required by law or by an authority.

## Definition

Corrective action is the action an economic operator takes to bring a non-compliant product into
conformity, to withdraw it from the market, or to recall it, either on the operator's own
initiative or because a market surveillance authority has required it.

## Expanded Explanation

Regulation (EU) 2019/1020 places the first duty on the operator: where an operator has reason to
believe a product it has placed on the market is non-compliant, it must take the corrective action
needed without delay. Where the operator does not act, or does not act adequately, the authority may
require action and, failing that, take measures itself.

Corrective action is a ladder rather than a single step. It runs from correcting information or
documentation, through bringing the product into conformity, to withdrawal from the market and, at
the top of the ladder, recall from end users. The step chosen must be proportionate to the
non-compliance and the risk.

For Digital Product Passports, a large share of realistic non-compliance is informational: a missing
required data point, an inaccurate value, a broken data carrier or an unavailable passport. Those
failures are corrected by republishing accurate information rather than by touching the physical
product, but they are still corrective action in the legal sense.

## Why It Matters

Treating a data defect as a content bug rather than a regulatory event is the most common process
failure. Corrective action needs an owner, a clock and a record, because an authority will ask when
the operator knew and what it did next.

## Legal and Regulatory Context

The obligation sits in Regulation (EU) 2019/1020, in particular the operator duties in Article 7 and
the authority powers in Articles 14 and 16. Product-specific measures adopted under Regulation (EU)
2024/1781 apply in addition, where the product-specific measure requires it.

## Relationship to Adjacent Concepts

Withdrawal and recall are specific forms of corrective action. Not every corrective action reaches
either of them.

## Common Misconceptions

#### Corrective action only means a recall

Recall is the most severe form. Most corrective action is corrective in the ordinary sense: fixing
the information, documentation or labelling and preventing recurrence.
